1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of BiteBuddy’s websites, restaurant ordering pages, customer account features, and the BiteBuddy Restaurant Manager tablet application (collectively, the “Services”).
The Services are operated by Whitespace Studio LLP, operating as BiteBuddy (“BiteBuddy,” “we,” “us,” or “our”), a business based in Richmond, British Columbia, Canada.
By accessing or using the Services, including browsing a participating restaurant page, placing an order, creating an account, joining optional customer programs, or using the Restaurant Manager app, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not use the Services.
2. Platform Role and Relationship with Restaurants
BiteBuddy provides a technology platform that enables customers to place orders with participating restaurants.
Participating restaurants are independent businesses. They are not employees, agents, partners, or representatives of BiteBuddy.
Restaurants are solely responsible for:
- food preparation;
- menu accuracy;
- pricing;
- availability;
- food quality and safety;
- pickup or delivery fulfillment; and
- compliance with laws applicable to their restaurant operations.
BiteBuddy does not prepare food, control restaurant operations, or guarantee the quality, safety, legality, or availability of food or beverages.
Unless applicable law provides otherwise, any contract for the purchase of food or beverages is formed directly between you and the restaurant when the order is accepted.
3. Eligibility
You must be at least 13 years of age to use the Services.
By using the Services, you represent that:
- you have the legal capacity to enter into binding agreements; and
- all information you provide is accurate, current, and complete.
4. Accounts and Optional Customer Features
You may create a BiteBuddy account to use certain features.
You are responsible for:
- maintaining the confidentiality of your login credentials;
- all activity under your account; and
- keeping your account information reasonably accurate.
Not every restaurant offers the same features. Depending on the restaurant, available features may include:
- guest checkout;
- account-based ordering;
- loyalty or rewards;
- coupons or customer offers;
- saved preferences;
- scheduled ordering; and
- brand-group features shared across related locations.
We may suspend, restrict, or terminate accounts that violate these Terms or that are associated with fraud, abuse, or security risks.
5. Related Locations and Brand Groups
Some participating restaurants may be part of the same brand group, such as:
- sister locations under one brand;
- related locations operated by the same owner or company; or
- participating locations in the same franchise or brand program.
Where clearly disclosed, related locations within the same brand group may share certain customer program features, such as:
- account or membership status;
- loyalty points or rewards balances;
- offers or coupons;
- order history within that brand group; and
- brand-group marketing preferences.
If a restaurant is not identified as part of the same disclosed brand group, it will be treated as a separate participating restaurant for customer program purposes.
6. Store-Specific Disclosures and Feature Availability
Each restaurant may have its own store-specific disclosures, including:
- business identity;
- hours of operation;
- pickup or delivery availability;
- menu availability;
- estimated preparation or pickup times;
- payment options;
- refund or cancellation rules;
- loyalty, coupon, or offer availability; and
- whether the restaurant participates in a shared brand-group program.
Store-specific disclosures shown on the relevant restaurant page, checkout flow, help center, or linked policy page are part of the ordering experience for that restaurant and may supplement these Terms.
7. Orders
7.1 Placing orders
When you place an order, you agree that:
- you will pay the full amount shown at checkout, including taxes and applicable fees;
- the information you provide is accurate;
- the order may be subject to availability, acceptance, and security checks; and
- the restaurant may decline or cancel an order in certain circumstances, including unavailability, pricing errors, suspected fraud, or operational issues.
An order is not final until:
- payment is successfully authorized, if applicable; and
- the restaurant accepts the order, where acceptance applies.
7.2 Scheduled orders
Some restaurants may allow you to place an order for a future time.
Scheduled times are estimates and may vary based on restaurant operations, demand, staffing, and other conditions.
7.3 Order changes and cancellations
Once submitted, orders may not be changed or cancelled unless permitted by the restaurant or required by applicable law.
Cancellation and refund decisions are generally determined by the restaurant’s policies, subject to applicable law and any platform processes used to support those decisions.
8. Pricing, Availability, Taxes, and Promotions
Restaurants are responsible for their menu pricing, item availability, and restaurant-specific operational settings.
Displayed prices, taxes, estimated times, and promotional availability may change before checkout or before the restaurant accepts the order.
Promotions, coupons, loyalty redemptions, and offers may be:
- restaurant-specific;
- brand-group-specific where disclosed;
- time-limited;
- subject to eligibility criteria;
- limited by quantity, timing, or inventory; or
- unavailable at certain participating restaurants.
9. Payments
Payments may be processed through third-party payment processors such as Stripe.
You authorize BiteBuddy and its payment processor to charge your selected payment method for the amount shown at checkout and any lawful adjustments related to your transaction.
BiteBuddy does not store full credit card numbers.
If payment authorization fails, expires, is invalidated, or cannot be completed, your order may not be processed.
10. Refunds, Chargebacks, and Payment Disputes
Refund eligibility is determined by the restaurant’s policies, applicable law, and any platform workflow used to process the refund.
If you believe you were incorrectly charged, you should first contact the restaurant or BiteBuddy support.
If you initiate a chargeback or payment dispute through your payment provider:
- we and/or the restaurant may provide transaction records, order details, timestamps, device or IP-related signals, and verification records as evidence;
- accounts associated with fraudulent, abusive, or repeated improper chargebacks may be restricted or suspended; and
- any loyalty, coupon, or offer benefits connected to the disputed transaction may be reversed where permitted by law and platform rules.
11. Loyalty, Rewards, Coupons, and Offers
Some participating restaurants may offer loyalty, rewards, coupons, or customer offers.
Unless otherwise stated:
- these programs are optional;
- they are only available at participating restaurants or participating brand groups;
- they may be modified, limited, suspended, or discontinued at any time;
- they may be subject to expiration dates, redemption rules, or usage limits;
- they are not redeemable for cash except where required by law; and
- abuse, fraud, duplicate-account manipulation, or misuse of promotions may result in cancellation, reversal, suspension, or loss of program access.
Where a restaurant participates in a disclosed brand-group program, certain loyalty or offer features may work across related locations under that brand group.
12. Communications
By using the Services, you agree that we may send you service-related communications, including:
- order confirmations;
- receipts;
- pickup or fulfillment updates;
- account or security notices; and
- support-related communications.
Marketing communications are separate and are governed by your applicable consent choices and our Privacy Policy.
13. User Conduct
You agree not to:
- engage in fraudulent or deceptive transactions;
- submit false or misleading information;
- abuse refund, chargeback, coupon, loyalty, or offer systems;
- interfere with the security, integrity, or operation of the Services;
- use bots, scripts, or automated systems to misuse the platform;
- attempt unauthorized access to accounts, devices, or data; or
- use the Services in violation of applicable law.
We reserve the right to block transactions, require verification, restrict accounts, or suspend access where we reasonably suspect misuse, fraud, abuse, or security risk.
14. Restaurant Operator Terms (Merchant Use)
If you access the BiteBuddy Restaurant Manager tablet application or related operator tools as restaurant staff:
- access is limited to authorized users;
- you may access only the data and restaurants you are authorized to manage;
- you are responsible for maintaining secure credentials and device access;
- you must comply with applicable privacy, consumer protection, and operational laws; and
- you must not use customer information except as authorized for legitimate restaurant operations.
We reserve the right to suspend merchant or operator access for violations.
15. Service Availability
We strive to provide reliable Services, but we do not guarantee uninterrupted, secure, or error-free operation.
The Services may be unavailable or limited due to:
- maintenance;
- system updates;
- restaurant-side issues;
- network interruptions;
- third-party provider outages;
- security responses; or
- circumstances beyond our reasonable control.
16. Intellectual Property
All platform software, BiteBuddy branding, design elements, and non-restaurant platform content are owned by BiteBuddy or its licensors.
Restaurant names, logos, menus, and related restaurant content may be owned by the participating restaurant or its licensors.
Except as permitted by law, you may not copy, reproduce, distribute, modify, reverse engineer, or create derivative works from the Services without permission.
17. Disclaimer and Limitation of Liability
To the fullest extent permitted by law:
- BiteBuddy is a technology platform provider only;
- BiteBuddy is not liable for the quality, safety, preparation, legality, or availability of food or beverages provided by restaurants;
- BiteBuddy is not liable for restaurant delays, cancellations, stock issues, fulfillment issues, or other restaurant-controlled matters; and
- BiteBuddy is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill.
To the fullest extent permitted by law, BiteBuddy’s total liability arising out of or relating to the Services shall not exceed the greater of:
- the total amount you paid for the specific order giving rise to the claim; or
- CAD $100.
Nothing in these Terms limits liability that cannot be limited under applicable law.
18. Indemnification
You agree to indemnify and hold harmless BiteBuddy and its affiliates, officers, employees, contractors, and agents from claims, damages, losses, liabilities, and expenses arising out of or related to:
- your misuse of the Services;
- your violation of these Terms;
- your fraudulent or unlawful conduct; or
- your infringement of another person’s rights.

Your use of the Services is also governed by our Privacy Policy, available at:
20. Changes to the Services or Terms
We may update these Terms from time to time.
Changes will be effective when posted, unless otherwise stated. Your continued use of the Services after an update becomes effective constitutes acceptance of the updated Terms.
21. Termination
We may suspend, restrict, or terminate access to the Services if:
- you violate these Terms;
- we detect fraud, abuse, or security concerns;
- a restaurant relationship ends and that affects the relevant service;
- required by law; or
- continued access would create operational, legal, or security risk.
You may stop using the Services at any time.
22. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the laws of Canada applicable therein, without regard to conflict-of-law principles.
Any disputes that cannot be resolved informally shall be brought in the courts located in British Columbia, Canada, unless applicable law requires otherwise.
