These Terms of Service (“Terms”) govern your access to and use of the BiteBuddy web ordering platform and the BiteBuddy Restaurant Manager tablet application (collectively, the “Services”).
The Services are operated by Whitespace Studio LLP (“BiteBuddy,” “we,” “us,” or “our”), a company registered in Richmond, British Columbia, Canada.
By accessing or using the Services, including placing an order, creating an account, or using the Restaurant Manager app, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not use the Services.
1. Acceptance of Terms
By using the Services, you agree to these Terms and our Privacy Policy.
2. Platform Role and Relationship with Restaurants
BiteBuddy provides a technology platform that enables customers to place orders with participating restaurants.
Participating restaurants are independent businesses and are not employees, agents, partners, or representatives of BiteBuddy.
- Restaurants are solely responsible for food preparation, quality, safety, and compliance with applicable laws.
- Restaurants are responsible for menu accuracy, pricing, availability, and fulfillment.
- BiteBuddy does not prepare food, control restaurant operations, or guarantee food quality.
Any contract for the purchase of food or beverages is formed directly between you and the restaurant when the order is accepted.
3. Eligibility
You must be at least 13 years of age to use the Services.
By using the Services, you represent that:
- You have the legal capacity to enter into binding agreements.
- All information you provide is accurate and complete.
4. Accounts
You may create an account to use certain features.
You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Orders
5.1 Placing Orders
When you place an order:
- You agree to pay the full amount shown at checkout, including taxes and applicable fees.
- You confirm that the information provided is accurate.
An order is not final until:
- Payment is successfully authorized, and
- The restaurant accepts the order (where applicable).
5.2 Scheduled Orders
If a restaurant is not accepting immediate orders, you may place a scheduled order for a future time, subject to restaurant availability.
Scheduled times are estimates and may vary due to operational conditions.
5.3 Order Modifications and Cancellations
Once submitted, orders may not be modified or cancelled unless permitted by the restaurant.
Cancellation and refund decisions are generally determined by the restaurant’s policy.
6. Payments
Payments are processed through a third-party payment processor (e.g., Stripe).
- BiteBuddy does not store full credit card numbers.
- You authorize us and our payment processor to charge your selected payment method.
If payment authorization fails, your order will not be processed.
7. Refunds and Chargebacks
Refund eligibility is determined by the restaurant’s policies and applicable laws.
If you believe you were incorrectly charged, you should contact the restaurant or BiteBuddy support first.
If you initiate a chargeback through your payment provider:
- We may provide transaction records, IP data, device signals, and verification logs as evidence.
- We reserve the right to suspend or restrict accounts associated with fraudulent or abusive chargebacks.
8. User Conduct
You agree not to:
- Engage in fraudulent transactions.
- Attempt to interfere with the security or integrity of the Services.
- Use automated systems to abuse the platform.
- Submit false claims or misuse refund processes.
We reserve the right to block transactions or suspend accounts suspected of misuse or fraud.
9. Restaurant Operator Terms (Merchant Use)
If you access the BiteBuddy Restaurant Manager tablet app as a restaurant operator:
- Access is limited to authorized merchant staff.
- You may access only your own restaurant’s data.
- You are responsible for maintaining secure access credentials.
- You must comply with applicable privacy and consumer protection laws.
We reserve the right to suspend merchant access for violations.
10. Service Availability
We strive to provide reliable Services but do not guarantee uninterrupted or error-free operation.
The Services may be temporarily unavailable due to:
- Maintenance,
- System updates,
- Network disruptions,
- Circumstances beyond our control.
11. Limitation of Liability
To the fullest extent permitted by law:
- BiteBuddy is not liable for the quality, safety, or legality of food provided by restaurants.
- BiteBuddy is not responsible for delays caused by restaurants or external factors.
In no event shall BiteBuddy’s total liability exceed the greater of:
- The total amount paid by you for the specific order giving rise to the claim, or
- CAD $100.
We are not liable for indirect, incidental, special, or consequential damages.
12. Indemnification
You agree to indemnify and hold harmless BiteBuddy and its affiliates from claims, damages, or expenses arising from:
- Your misuse of the Services,
- Your violation of these Terms,
- Fraudulent or unlawful conduct.
13. Intellectual Property
All platform software, branding, and content (excluding restaurant menus and branding) are owned by BiteBuddy or its licensors.
You may not copy, distribute, or modify the Services without permission.

Your use of the Services is also governed by our Privacy Policy:

We may update these Terms from time to time.
Changes will be effective when posted. Continued use of the Services constitutes acceptance of updated Terms.
16. Termination
We may suspend or terminate access to the Services if:
- You violate these Terms,
- We detect fraud or misuse,
- Required by law.
You may stop using the Services at any time.
17. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the laws of Canada applicable therein.
Any disputes shall be resolved in the courts located in British Columbia, Canada.
